1. Scope of Application
These Terms and Conditions (T&C) apply to all product sales made by La 3ème dimension, a sole proprietorship registered under the above SIRET number. They apply to any buyer, consumer or professional, wishing to purchase a product on the website. Any order implies unreserved acceptance of these T&C by the Buyer.
2. Products
The products offered for sale are creations made by 3D printing, presented with their essential characteristics on the website. Since products are manufactured by 3D printing, slight variations in texture, color or finish may exist compared to the photos presented, without constituting a lack of conformity.
3. Prices
Prices displayed are in euros (€), all taxes included (TTC). VAT not applicable – article 293 B of the French General Tax Code (sole proprietorship). Shipping costs are indicated separately when placing the order. La 3ème dimension reserves the right to modify its prices at any time, it being understood that the applicable price is that in force at the time of order validation.
4. Order
The Buyer places an order via the website. The order is considered accepted when La 3ème dimension receives full or partial payment of the price, according to agreed terms.
5. Payment Methods
Payment is made by the means offered on the website (credit card, PayPal, etc.). Payment is secure. Products remain the property of La 3ème dimension until full payment.
6. Delivery
Products are delivered to the address indicated by the Buyer when ordering. Delivery times are given as an indication. In accordance with article L216-1 of the French Consumer Code, in the absence of an agreed deadline, the seller delivers the goods within a maximum period of 30 days. If this deadline is exceeded, the Buyer may cancel the order and obtain a full refund.
7. Transfer of Risk
The risks related to the products are transferred to the Buyer at the time of delivery of the products to the carrier.
8. Right of Withdrawal, Returns and Refunds
8.1 Right of Withdrawal
In accordance with articles L221-18 and following of the French Consumer Code, the consumer has a period of 14 days from receipt of the order to exercise the right of withdrawal, without justification or penalty. To exercise this right, the consumer must notify the decision by email to: la3emedim@gmail.com
8.2 Return Acceptance Conditions
To be eligible for return, the product must:
- be in the same condition as when received
- not have been used, modified or damaged
- be returned in its original packaging, with all accessories provided
- be accompanied by the receipt or proof of purchase
Any product not meeting these conditions may be subject to refusal of refund or partial refund.
8.3 Return Procedure
Before any return, the consumer must make a prior request by email to: la3emedim@gmail.com. Return costs are the responsibility of the consumer, except in case of seller error. Items returned without prior request will not be accepted. Once accepted, the seller will communicate shipping instructions (address and terms).
8.4 Damaged, Defective Products or Order Error
The consumer must check the condition of products upon receipt. In case of defective, damaged or non-compliant product, the consumer must contact La 3ème dimension as soon as possible at: la3emedim@gmail.com. An appropriate solution (replacement or refund) will be offered.
8.5 Exceptions to the Right of Withdrawal
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:
- products made to order or customized according to consumer specifications
- products that cannot be returned for hygiene or health protection reasons if unsealed after delivery
8.6 Exchanges
Exchanges are not offered. The consumer wishing for another product must return the item in accordance with these conditions and then place a new order.
8.7 Refunds
After receipt and inspection of the returned product, the consumer will be informed by email of the acceptance or refusal of the refund. If accepted, the refund will be made to the payment method used, within a maximum period of 10 business days. Banking deadlines may vary depending on the financial institution. 9. Legal Warranties
Products benefit from legal warranties provided by the French Consumer Code (conformity, hidden defects). Any warranty request must be accompanied by proof of purchase.
10. Liability
The liability of La 3ème dimension is limited to the amount of the order. It cannot be held responsible for indirect damages.
11. Force Majeure
Neither party may be held responsible in case of force majeure (article 1218 of the French Civil Code).
12. Personal Data
Data collected when ordering is used only for order processing and management, in accordance with the privacy policy.
13. Intellectual Property
The creations, texts, images, 3D models and other elements of the website are the exclusive property of La 3ème dimension. Any reproduction is prohibited without prior authorization.
14. Disputes – Applicable Law
These T&C are governed by French law. In case of dispute, an attempt at amicable resolution will be sought. Failing this, French courts will have jurisdiction.
